Terms of Use
Tallydown helps you see your FSA deadline and plan what to spend. It doesn't give tax, medical, legal or financial advice. Always confirm with your plan administrator.
These terms apply to the Tallydown app for iPhone. "We" means the developer, José María Márquez. By using Tallydown you agree to them.
Apple's license agreement
Tallydown is licensed to you under Apple's Licensed Application End User License Agreement (the "Standard EULA"). These terms add to it. Where they differ, the Standard EULA wins.
Not advice
Tallydown is an organizing tool. Its deadlines, amounts, checklists and spending plans are estimates based on what you enter and on general FSA rules. They are not tax, medical, legal or financial advice.
- Eligibility: Tallydown never promises that an expense is FSA-eligible. Your plan administrator decides what it reimburses.
- Deadlines: grace periods, carryover limits and claim run-out dates differ by employer. Check your plan documents.
- Your balance: Tallydown doesn't connect to your FSA account. Its numbers are only as current as the balance and expenses you enter.
- Health: suggestions such as "book an eye exam" are reminders of common FSA uses, not medical recommendations.
You're responsible for decisions you make about your FSA, including submitting claims on time.
Tallydown Pro
Tallydown Pro is a one-time, non-subscription purchase that unlocks features such as unlimited expenses, the spending plan, reminders and all widgets. It's sold and billed by Apple. Refunds are handled by Apple at reportaproblem.apple.com. You can restore Pro on your devices with the same Apple ID.
We may improve, change or remove features over time. We won't take away a Pro feature you paid for without offering a reasonable replacement.
Your data
Your data stays on your iPhone, as described in the Privacy Policy. Keep your device backed up. We can't recover data that is lost with your device or deleted with the app.
No warranty
Tallydown is provided "as is" and "as available". To the extent the law allows, we make no warranty that it is error-free, that its calculations fit your plan, or that it will always be available.
Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential losses, or for FSA funds that are forfeited, unreimbursed or spent on ineligible items. Our total liability is limited to the amount you paid for Tallydown and Tallydown Pro. Nothing in these terms limits liability that can't be limited by law.
Changes
We may update these terms. The date at the top shows when they last changed. If you keep using Tallydown after a change, the new terms apply.
